The separation of church and state isn’t dead yet…“Act 573’s purpose is only to display a sacred, religious text in a prominent place in every public-school classroom.

The judge wrote that state lawmakers “may have lost sight of the fact that ‘a union of government and religion tends to destroy government and to degrade religion.'”

“The law serves no educational purpose, as the State admits, and consequently deprives Plaintiffs of their rights,” he added.

He ruled that the law blatantly violates the Establishment Clause and violates the religious freedom rights of the plaintiffs, a group of multifaith families with children enrolled in Arkansas schools. Brooks’ decision will effect several school districts but does not amount to a statewide ban on the law.
