F’High Court Dismisses Suit Challenging ICPC’s Power To Probe Kano Scholarship Funds

A Federal Capital Territory (FCT) High Court has dismissed a lawsuit seeking to stop the Independent Corrupt Practices and Other Related Offences Commission (ICPC) from investigating alleged financial mismanagement of scholarship funds in Kano State.. .. Read ..Full.. Article.. .

Justice Josephine Obanor, who presided over the case, ruled that the ICPC acted within its lawful mandate by initiating an investigation following a petition that raised concerns about the administration of the funds.

The Commission had invited officials from the Kano State Ministry of Higher Education and the Kano State Scholarship Board to provide relevant documents and explanations.

Instead of complying, the officials, led by the Permanent Secretary of the Ministry, Dr. Hadi Bala, filed a suit marked CV/2857/2025 against the Attorney-General of the Federation and the ICPC, claiming the invitations infringed on their fundamental rights.

In her judgment, Justice Obanor struck out the Attorney-General of the Federation as a party to the suit, stating that the inclusion was unnecessary.

She also directed that officials of the Kano State Scholarship Board be correctly joined in the proceedings.

Crucially, the court held that an investigative invitation from the ICPC does not amount to a violation of fundamental rights, and the applicants failed to provide evidence of any such breach.
